Content Compliance, Verification, Moderation and Complaint Handling Policy

For content produced directly by BLM Services, the company maintains control over the production, curation, review, and publication process.

For licensed content, BLM Services obtains appropriate rights or authorization to publish the content from the applicable content provider or rights holder. Where appropriate, the company may require the provider or rights holder to provide or confirm documentation relating to age, identity, consent, releases, ownership, licensing rights, or other compliance requirements.

Content is reviewed prior to publication to the extent reasonably practicable. Content that is known or reasonably suspected to involve prohibited or illegal activity will not knowingly be published or will be removed from the platform when identified.

The company may request additional information or supporting documentation from a third-party content provider or rights holder when necessary to verify compliance.

3. Age, Identity and Consent Verification

Before content is published, BLM Services takes reasonable steps appropriate to the circumstances to establish that individuals appearing in the content are adults and have consented to the creation and publication of the content.

For content produced directly by BLM Services, the company obtains and maintains appropriate identification, age-verification, consent, release, or other supporting documentation as required by applicable law and the company's procedures.

For licensed content, BLM Services may rely on documentation, representations, warranties, certifications, or other information provided by the applicable content producer, studio, creator, distributor, or rights holder, as appropriate to the circumstances.

Where appropriate, BLM Services may request supporting documentation from a licensing partner or content provider to confirm that applicable age, identity, and consent requirements have been satisfied.

The company does not knowingly publish content involving a person who is under the applicable legal age or who has not provided appropriate consent.

If the company becomes aware of information that reasonably calls the age, identity, consent, or authorization associated with licensed content into question, the company may suspend or remove the content while the matter is investigated.

4. Recordkeeping and Documentation

Records and supporting documentation relating to content, performers, age verification, identity verification, consent, releases, licensing rights, and other applicable compliance matters are collected and maintained as appropriate for the business and applicable legal requirements.

For content produced directly by BLM Services, the company maintains applicable records and documentation obtained during its own production and publication processes.

For licensed content, BLM Services maintains appropriate records relating to the source of the content, licensing or publication rights, and compliance information or documentation provided by the applicable content provider or rights holder, to the extent appropriate and available.

Records are stored securely and access is limited to persons who require access for legitimate business or compliance purposes.

Records will be made available to appropriate authorities or other authorized parties when required by applicable law or valid legal process.

5. Content Review and Moderation

Content is reviewed before publication to the extent reasonably practicable, regardless of whether the content is produced directly by BLM Services or obtained through a licensing arrangement.

The review process is intended to identify and prevent prohibited material, including but not limited to:

  • CSAM or any sexual content involving minors;

  • non-consensual sexual content;

  • content involving human trafficking or commercial sexual exploitation;

  • content involving forced labor;

  • content depicting or promoting illegal sexual activity;

  • content that violates applicable laws or payment-processing requirements; and

  • other content that the company determines is prohibited.

For licensed content, the company may also review information supplied by the content provider or rights holder concerning the origin of the content, licensing authorization, age verification, consent, releases, and other relevant compliance matters.

If content raises a compliance concern, publication may be delayed, rejected, suspended, or the content may be removed while the matter is investigated.

6. Content Removal Requests

BLM Services provides a process for individuals to report abusive or illegal content or request the removal of content from its platform.

To assist BLM Services in reviewing and resolving a request, the reporting party should provide:

  • Their email address;

  • Their legal name;

  • The URL or specific location of the content being reported;

  • An explanation of why the content is believed to be abusive, illegal, non-consensual, or otherwise in violation of applicable requirements;

  • Any additional information that may assist BLM Services in reviewing and resolving the request; and

  • A digital signature consisting of the reporting person's name, confirming that the information provided is accurate and that the person submitting the request is the person identified in the request.

If a request is submitted on behalf of another person appearing in the content, the reporting party should also provide their legal name and their relationship or association with the person appearing in the content.

Removal requests are reviewed promptly and are treated seriously, particularly where the request concerns lack of consent, mistaken identity, age-related concerns, trafficking, exploitation, unauthorized publication, licensing or ownership disputes, or other potentially illegal activity.

Where appropriate, content may be temporarily suspended while a complaint or removal request is investigated.

For licensed content, BLM Services may contact the applicable content provider, studio, creator, distributor, or rights holder when necessary to investigate a removal request or determine whether the company has continuing authorization to publish the content.

BLM Services will resolve and respond to reported complaints within five (5) business days or sooner, where reasonably practicable.

Records of significant removal requests and their resolution will be maintained where appropriate.

BLM Services reserves the right to take appropriate action regarding knowingly false, fraudulent, or abusive removal requests, as such requests may interfere with the company's ability to process legitimate and actionable complaints.

7. Complaints and Disputes

Complaints concerning content, consent, privacy, identity, licensing rights, unauthorized publication, or other compliance matters may be submitted through the company's designated contact method:

Complaints will be reviewed based on the information provided and any relevant records available to BLM Services

Where a complaint identifies a potential violation of this policy or applicable law, appropriate action may include:

  • Removing or restricting access to the relevant content;

  • Requesting additional information or documentation;

  • Contacting the relevant content provider, rights holder, or other affected party where appropriate;

  • Suspending publication while the matter is investigated; and

BLM Services will resolve and respond to reported complaints within five (5) business days or sooner, where reasonably practicable.

The company will maintain appropriate records of material complaints and their resolution.


8. Escalation of Illegal or Concerning Content

If the company becomes aware of content or conduct that appears to involve serious illegal activity, including suspected CSAM, human trafficking, commercial sexual exploitation, forced labor, or non-consensual sexual content, the matter will be escalated for immediate review.

This applies to both content produced directly by BLM Services and content obtained through third-party licensing arrangements.

Where a concern involves licensed content, the company may suspend publication and contact the applicable content provider, rights holder, or licensing partner while the matter is investigated.

Where required or appropriate, the company will cooperate with law enforcement or other competent authorities and will provide information or records when legally required or otherwise lawfully requested.

Content that is suspected to be illegal will not knowingly remain available while the matter is being appropriately addressed.

9. Cooperation With Legal and Compliance Requirements

BLM Services is committed to complying with applicable laws, regulations, payment-processor requirements, and other legitimate compliance obligations applicable to its business.

The company will cooperate with lawful requests from payment processors, regulators, law enforcement agencies, or other authorized parties.

The company also expects third-party content providers, licensors, studios, creators, distributors, and other rights holders from whom content is obtained to comply with applicable laws and maintain appropriate rights and documentation relating to the content they provide.

Where appropriate, BLM Services may request documentation or information from such parties to verify compliance with applicable requirements.

10. Policy Review

This policy will be reviewed periodically and updated when necessary to reflect changes in applicable laws, payment-processing requirements, business practices, licensing arrangements, or compliance procedures.

 

11. Appeals Policy

Any person depicted in content published on the BLM Services platform may appeal for the removal of content in which they appear.

An appeal may be submitted by email to:

  • The person submitting the appeal should provide:
  • Their legal name and email address;
  • The URL or specific location of the content at issue;
  • Sufficient information to identify themselves as the person depicted in the content;

The reason they are requesting removal, including whether they believe they did not consent to the creation or publication of the content, their consent was invalid or is void under applicable law, or the content is otherwise being published without lawful authorization; and

Any additional information or documentation that may assist BLM Services in reviewing the appeal.

BLM Services will promptly investigate the appeal and may temporarily suspend or restrict access to the content while the appeal is being reviewed. The company may review relevant consent forms, releases, identification records, licensing records, communications, or other documentation and may contact the applicable content provider, producer, studio, creator, distributor, or rights holder when necessary to investigate the appeal.

If the investigation determines that consent was not given, is invalid or void under applicable law, or that BLM Services otherwise lacks lawful authorization to publish the content, the content will be removed.

BLM Services will resolve and respond to appeals within five (5) business days or sooner, where reasonably practicable.

If the person depicted in the content disagrees with the outcome of the appeal, the disagreement may be submitted for resolution by a neutral third-party body. BLM Services will bear the cost of the neutral third-party review. BLM Services will comply with the outcome of that review as required by applicable law and payment-processing requirements.

Records of material appeals and their resolution will be maintained where appropriate.
